Ancillary Probate

"Ancillary Probate" refers to the adminstration of an estate of a decedent who is the resident of another state. If the decedent owns personal property (includingbank accounts, investment accounts, or other financial items) or real property in Michigan, the adminstrator (personal representative) must acquire some official authority to conduct business in Michigan.
If official administration of the estate is established in the decedents state of residence, the Michigan requirements are relatively simple and require the filing a Court Approved form along with some authenticated proof of appointment in the other state.
If no official administration is established in another state, a standard Michigan Probate Proceeding will have to be commenced.
